CSK Auto Exec Can't Get $4M SOX Clawback Suit Nixed

Law360, New York (June 10, 2010, 7:40 PM EDT) -- A judge has refused to dismiss the U.S. Securities and Exchange Commission's case seeking to force ex-CSK Auto Corp. CEO Maynard Jenkins to pay back the $4.1 million he received after other CSK executives allegedly cooked the company's books, even though Jenkins isn't accused of being involved in the accounting fraud scheme.

Judge G. Murray Snow of the U.S. District Court for the District of Arizona signed off on an order Wednesday denying Jenkins' September 2009 dismissal bid, and holding that the SEC had alleged facts...
