Federal Circuit: Abbott Did Not Infringe Novartis Patent For Human Transplant Drug

Law360 (July 13, 2004, 12:00 AM EDT) -- The Court of Appeals for the Federal Circuit has upheld a lower court’s ruling that Abbott Laboratories did not infringe a Novartis patent for the human transplant drug cyclosporine.

In a decision issued last week, the Federal Circuit said it found the district court’s claim construction was erroneous, but concluded that there had been no error in the district court’s grant of a judgment as a matter of law in favor of Abbott.
