Sideless Platform Containers Are Still Containers: CIT

Law360, New York (June 17, 2010, 2:42 PM EDT) -- The U.S. Court of International Trade has found that Pacific Northwest Equipment Inc.'s sideless platform containers are properly classified as containers, rejecting U.S. Customs and Border Protection's contention that the products are just platforms.

Judge Gregory W. Carman of the CIT on Tuesday granted PNW Equipment's motion for summary judgment, finding that despite not having walls, doors or ceilings, the platform containers are containers because they keep objects within limits during transportation.
