DC Circ. Rejects Canadian Pacific Rail Deal Challenges

Law360, New York (June 16, 2010, 4:29 PM EDT) -- A federal appeals court has rejected challenges to Canadian Pacific Railway Corp.'s 2008 acquisition of Dakota Minnesota & Eastern Railroad Corp. over its lack of an environmental impact study and its effect on a Chicago-area commuter line.

The U.S. Court of Appeals for the D.C. Circuit on Tuesday upheld the U.S. Surface Transportation Board's September 2008 decision to approve the merger despite challenges from the Sierra Club and Chicago's Metra commuter line.
