Appeals Court Dismisses Suit Against Insurer

Law360 (January 31, 2007, 12:00 AM EST) -- An appellate court affirmed a district court’s decision Tuesday to dismiss a proposed class action brought by a Michigan couple against their insurance company alleging improper rate hikes.

Burl and Cathy McLiechey filed suit against Bristol West Insurance Co. in June 2005 after the company changed their policy and raised their rates.

The change came after the McLiecheys moved to a higher risk area, received a poorer credit rating and let their insurance lapse for two weeks because they could not pay their premiums, court documents...
