Insurers Escape Liability In Mylan Antitrust Suits

Law360, New York (June 22, 2010, 4:52 PM EDT) -- The highest court in West Virginia has denied a bid by Mylan Pharmaceuticals Inc. to force its insurers to pay millions of dollars for two sets of lawsuits alleging the generics maker inflated the average wholesale price of its drugs and overcharged customers for Lorazepam and Clorazepate.

The Supreme Court of Appeals of West Virginia issued the ruling Thursday, affirming the finding of the lower court. Mylan had sought coverage under advertising injury, bodily injury and discrimination provisions of its insurance policies.
