Apotex Fends Off Patent Suit Over Pinkeye Treatment

Law360, New York (June 22, 2010, 7:38 PM EDT) -- Apotex Inc. has prevailed in a suit brought by Senju Pharmaceutical Co. Ltd., Kyorin Pharmaceutical Co. Ltd. and Allergan Inc. over the Canadian generic-drug maker's alleged attempts to horn in on the market for the pinkeye treatment Zymar, convincing a judge that the asserted claims of a patent co-owned by Senju and Kyorin were invalid.

Judge Sue L. Robinson of the U.S. District Court for the District of Delaware signed off on a judgment in favor of Apotex on Monday.
