Dutch Court Nixes Energy Antitrust Law

Law360, New York (June 23, 2010, 4:52 PM EDT) -- The Netherlands Court of Justice has overturned a Dutch law that would have forced energy companies to unbundle commercial and transmission operations, handing a victory to Eneco, Essent NV and Delta Energy BV.

The court ruled that the law conflicted with European Union law, Eneco said Tuesday.

The company would have been required to unbundle its operations by Jan 1. The Dutch government has said it will appeal the decision to the country's Supreme Court, but is unlikely to get a judgment by that date, according...
