Massey Units Sue MSHA Over Mine Ventilation Plans

Law360, New York (June 23, 2010, 1:27 PM EDT) -- Several units of Massey Energy Co. — the owner of the West Virginia mine where an April explosion killed 29 workers — are accusing the federal Mine Safety and Health Administration of blocking proposed ventilation methods that would protect miners.

Six Massey subsidiaries filed suit Tuesday in U.S. District Court for the District of Columbia, claiming that the agency has violated their right to due process and improperly used its regulatory authority to control the design of mine ventilation systems.
