Del. Diocese Can't File Amicus Brief In Abuse Case

Law360, New York (June 24, 2010, 7:28 PM EDT) -- In an increasingly bitter court dispute, the Delaware Supreme Court on Thursday denied a bid by bankrupt Catholic Diocese of Wilmington Inc. to lend its voice to a lawsuit by a man who claims he was sexually abused by a priest.

The court denied the diocese's proposed order for leave to file a brief alleging James E. Sheehan's claims and 147 similar ones were time-barred, on the ground that such a move would be unconstitutional.
