Flood Of Remands Begins In Void NLRB Cases

Law360, New York (June 25, 2010, 3:11 PM EDT) -- Federal appeals courts have started grappling with a glut of cases they will have to send back to the National Labor Relations Board following the U.S. Supreme Court’s ruling undoing the authority of a two-member NLRB, as attorneys await direction from the agency on how it will handle the actions.

The U.S. Court of Appeals for the Eighth Circuit was just one appeals court to issue a terse order this week remanding a labor case to the NLRB, although dozens more are expected to follow....
