US Alleges Witness Bias In Target Gazebo Rate Case

Law360, New York (June 25, 2010, 2:05 PM EDT) -- The federal government has submitted a post-trial brief defending an 8.8 percent tariff rate on gazebos imported from China, saying Target Corp. relied on unqualified witnesses in its potentially broad-reaching test case challenging the classification.

Two of Target's witnesses knew too little about the disputed gazebos to act as authorities, while three others were biased and had ties to Target's counsel, the federal government contended Thursday in a 55-page brief in the U.S. Court of International Trade.
