Johnson Controls Wins Spat Over CERCLA Coverage

Law360, New York (June 28, 2010, 7:27 PM EDT) -- The Wisconsin Supreme Court has ruled that insurer London Market must indemnify Johnson Controls Inc. for defense costs it incurred in relation to environmental damages in the 1970s under an excess umbrella policy.

Justice Ann Walsh Bradley, writing for the 4-3 majority, ruled Thursday that London Market had a duty to defend because the underlying primary insurance policy, issued by Travelers Indemnity Co., expressly included a duty to defend, which carried over to the excess umbrella policy.
