PTO Shoots Down Benitec’s Patent Claims

Law360, New York (February 1, 2007, 12:00 AM EST) -- Biotechnology company Nucleonics Inc. said Thursday that the U.S. Patent and Trademark Office has rejected the remaining claims of rival Benitec’s patent on gene silencing technologies.

This marked the second time the USPTO has rejected Benitec’s patent claims, according to Nucleonics, and constituted another victory in its “multi-pronged approach” to invalidating Benitec’s intellectual property worldwide.

Benitec can still appeal the decision, however, and the USPTO has yet to issue a final ruling.
