Green Groups Lose Challenge To Katrina Landfill Permit

Law360, New York (June 29, 2010, 12:38 PM EDT) -- A Louisiana appeals court has upheld the Louisiana Department of Environmental Quality’s determination that an emergency landfill for debris from Hurricane Katrina would not violate water standards, handing environmental groups their second loss in a fight over permitting for a site they say leaches harmful chemicals.

On Friday a majority of the Louisiana First Circuit Court of Appeal held that a lower court correctly backed the environmental agency’s issuance of the water quality certification Waste Management LLC needed to construct and operate the Chef Menteur landfill...
