AstraZeneca Crestor Patent Found Valid, Enforceable

Law360, New York (June 29, 2010, 7:50 PM EDT) -- A federal judge ruled Tuesday that a patent covering AstraZeneca PLC's Crestor is valid and enforceable, handing the drugmaker a victory in its bid to block Mylan Pharmaceuticals Inc., Apotex Corp. and others from producing generic versions of the cholesterol drug.

Judge Joseph J. Farnan Jr. of the U.S. District Court for the District of Delaware concluded that the eight defendants failed to establish during an eight-day bench trial that U.S. Patent Number RE37,314, which covers Crestor's active ingredient rosuvastatin, is unenforceable due to inequitable conduct....
