NRC Rules Against US Bid To Drop Yucca Project

Law360, New York (June 30, 2010, 1:43 PM EDT) -- A three-judge panel of the U.S. Nuclear Regulatory Commission has denied a request by the U.S. Department of Energy to withdraw its application to build the Yucca Mountain nuclear waste repository in Nevada.

The panel ruled Tuesday that Congress had directed the DOE to file the application under the Nuclear Waste Policy Act of 1982, and the law does not provide any mechanism for the department to withdraw the application.
