Mass. High Court OKs Wind Project Over Protests

Law360, New York (July 6, 2010, 7:32 PM EDT) -- The highest court in Massachusetts affirmed Tuesday that the state's environmental agency complied with the Wetlands Protection Act when it approved a New England Wind LLC project for an access road crossing streams to build 20 wind turbines.

Striking a blow to 10 citizens groups, the Massachusetts Supreme Judicial Court agreed with a lower court that the state Department of Environmental Protection's decision to approve two gravel access roads, one of which would cross 12 streams.
