Court Dismisses Citizen Suit Against Oil Companies

Law360 (February 5, 2007, 12:00 AM EST) -- An appellate court Friday affirmed a lower court’s dismissal of a citizen suit against several energy companies alleging violations of the Clean Water Act.

The appeals court found that the suit brought against GHK Co., its subsidiaries and its owner, Robert Hefner; Wynn-Crosby; KCS Resources Inc. and El Dorado Dozers Inc., a bulldozer company, was not within the court’s jurisdiction and was settled by an Environmental Protection Agency consent decree following negotiations between the EPA and GHK.
