ConAgra Off Hook In Consumer 'Popcorn Lung' Suit

Law360, New York (July 7, 2010, 7:02 PM EDT) -- A federal judge has granted summary judgment to ConAgra Foods Inc. in a "popcorn lung" diacetyl lawsuit brought by a consumer who claimed that the company’s Butter Lovers popcorn caused severe respiratory damage and shortened his life expectancy.

Judge Rosanna Malouf Peterson of the U.S. District Court for the Eastern District of Washington on Friday elaborated on her brief June 24 decision to grant motions for summary judgment from defendants ConAgra and its suppliers — Symrise Inc. and Chr. Hansen Inc. — and dismissed the case....
