Hobet Mining Fails To Stop Selenium Suit

Law360, New York (July 13, 2010, 4:06 PM EDT) -- A federal judge has denied a last-ditch effort by Hobet Mining LLC to toss a suit brought by the Sierra Club and other environmental groups over selenium waste from a West Virginia coal mine, paving the way for an August hearing to address the terms of injunctive relief.

The August trial should give the court sufficient information to fashion relief that preserves and promotes the public interest, Judge Robert Chambers of the U.S. District Court for the Southern District of West Virginia said Monday.
