Plaintiffs Want Rader Recusal In Gene Patent Case

Law360, New York (July 16, 2010, 4:58 PM EDT) -- The two sides in the battle over whether human genetic material should be patentable have begun a row over Chief Judge Randall Rader's impartiality — the anti-patent plaintiffs want the reputedly pro-patent judge to recuse himself over recent remarks he made outside the courtroom.

Their recently filed brief adds an early wrinkle to the appellate litigation over whether Myriad Genetics Inc. has a right to patent a gene linked with breast cancer, a case that may redraw the boundaries of intellectual property law.
