5th Circ. Snuffs Xcaliber's Challenge To Settlement Law

Law360, New York (July 15, 2010, 7:31 PM EDT) -- A federal appeals court has upheld the dismissal of a case brought by discount cigarette maker Xcaliber International Ltd. LLC alleging Louisiana’s amendment to a statute implementing a major settlement with the top four cigarette makers violated antitrust and other laws.

The U.S. Court of Appeals for the Fifth Circuit on Thursday affirmed a summary judgment ruling in favor of Louisiana, finding that the district court properly dismissed Xcaliber’s claims that the amendment to state law breached the Sherman Act and equal protection and due process...
