Insurer Takes On Byrd Amendment In Honey Duty Suit

Law360, New York (July 20, 2010, 1:48 PM EDT) -- In another case challenging the government's application of the Byrd Amendment, International Fidelity Insurance Co. is suing the U.S. for denying its protests over duties imposed on honey imported from China.

The government inappropriately assessed a duty rate of $2.63 per kilogram on honey from China because pursuant to the Byrd Amendment that money was slated to be handed over to domestic industry, according to a summons filed Friday in the U.S. Court of International Trade.
