1st Circ. Upholds EPA Win In Wastewater Permit Spat

Law360, New York (July 20, 2010, 1:03 PM EDT) -- A federal appeals court has shot down an attempt by the city of Pittsfield, Mass., to overturn relatively harsh new pollution standards applied to its wastewater treatment plant, faulting the city's defective first appeal to the U.S. Environmental Protection Agency.

Pittsfield's generalized gripes about its new, more stringent permit gave the EPA's Environmental Appeals Board nothing to work with, the U.S. Court of Appeals for the First Circuit ruled in an opinion issued Friday.
