Mining Group Blasts EPA Over Valley Fill Permit Rules

Law360, New York (July 20, 2010, 1:56 PM EDT) -- The U.S. government has unlawfully impeded surface coal mining efforts in Appalachia by changing the requirements for obtaining Clean Water Act valley fill permits, according to a suit filed Tuesday by the National Mining Association.

The NMA brought its suit against the U.S. Environmental Protection Agency and the Army Corps of Engineers in the U.S. District Court for the District of Columbia, claiming that the defendants' actions amount to a de facto moratorium on permitting for coal mining.
