United Technologies Still On The Hook In CERCLA Spat

Law360, New York (July 23, 2010, 3:19 PM EDT) -- A prior settlement by United Technologies Corp. with the government in a long-running cleanup of a Superfund site in Rhode Island does not shield the company from a cost recovery action brought by chemical company Ashland Inc., a judge has ruled.

Ashland can go forward against United Technologies and several other defendants including Black & Decker Corp. and Rohm & Haas Co., Judge Mary M. Lisi of the U.S. District Court for the District of Rhode Island said in a summary judgment ruling Thursday.
