8th Circ. Says SensoryEffects Didn't Infringe Rival Mark

Law360, New York (July 23, 2010, 12:57 PM EDT) -- A federal appeals court has upheld a victory for SensoryEffects Flavor Co. in a trademark dispute brought by Sensient Flavors LLC., finding that no reasonable jury could confuse the two names.

Though both flavor companies sell over the phone and their names share a first syllable, the marks are dissimilar enough that customers will not be misled, the U.S. Court of Appeals for Eighth Circuit ruled Wednesday.
