ITC To Check Claim Ruling In Kodak Case V. Apple, RIM

Law360, New York (July 26, 2010, 1:32 PM EDT) -- Apple Inc. has prevailed upon the U.S. International Trade Commission to review a key claim construction ruling in Eastman Kodak Co.’s suit alleging the iPhone maker's smartphones, as well as those made by Research In Motion Ltd., infringe a patent for digital camera technology.

Thursday's 5-1 vote paves the way for the agency to take a look at whether Chief Administrative Law Judge Paul Luckern erred in his construction of the patent claim term “capture button” following a Markman hearing in June.
