Pa. Appeals Court OKs Stricter County Drilling Rules

Law360, New York (July 26, 2010, 4:58 PM EDT) -- A Pennsylvania appeals court has upheld a county ordinance that includes stricter permitting requirements for oil and gas drilling, finding that the rule is not preempted by the state's Oil and Gas Act because it is not aimed directly at the drilling industry.

The ruling, issued Thursday in the Commonwealth Court of Pennsylvania, could open the door for local governments throughout the Keystone State to adopt similar ordinances indirectly restricting oil and gas production, one attorney said.
