5th Circ. Upholds EPA Approach To Rig Cooling Systems

Law360, New York (July 26, 2010, 4:43 PM EDT) -- A federal appeals court has upheld the U.S. Environmental Protection Agency's national standard for the technology that keeps sea life from being sucked into newly constructed offshore oil rigs, shooting down the rig-by-rig regulatory approach pushed by ConocoPhillips Co. and Anadarko Petroleum Corp.

The EPA was within its rights to develop a single standard for the environmental technology used by cooling water intake structures, or CWISs, the U.S. Court of Appeals for the Fifth Circuit ruled Friday.
