4th Circ. Kills $1B Emissions Control Order Against TVA

Law360, New York (July 27, 2010, 5:01 PM EDT) -- A federal appeals court has overturned a ruling that would have required the Tennessee Valley Authority to spend over $1 billion to install emissions controls at four coal-fired power plants in Alabama and Tennessee.

The U.S. Court of Appeals for the Fourth Circuit on Monday reversed a ruling by the U.S. District Court for the Western District of North Carolina that found the four plants’ emissions to be a public nuisance in North Carolina and ordered the TVA to implement emissions control technologies by 2013....
