Duke Holds On To Power Plant Tax Credit For Now

Law360, New York (July 27, 2010, 4:24 PM EDT) -- A federal judge has rejected a bid by two environmental advocacy groups to stop the U.S. Department of Energy from giving a federal tax credit to Duke Energy Corp. for a planned cleaner coal power plant.

Judge Ricardo M. Urbina of the U.S. District Court for the District of Columbia on Monday denied Appalachian Voices and Canary Coalition’s motion for a preliminary injunction, finding that they had failed to show that the allocation of the tax credit threatened to cause them imminent irreparable injury.
