5 Penguin Species Deemed Threatened Under ESA

Law360, New York (August 2, 2010, 7:16 PM EDT) -- The U.S. Fish and Wildlife Service has named five species of penguin as threatened under the Endangered Species Act, bringing closure to a lengthy and litigious movement spearheaded by a pair of environmental groups in 2006.

The Humboldt penguin of Chile and Peru, as well as the yellow-eyed, white-flippered, Fiordland crested and erect-crested penguins of New Zealand, will be protected under the ESA, according to a Federal Register notice slated for publication by the FWS on Tuesday.
