NorthWestern Wins Enviro Policy Spat With Lloyd's

Law360, New York (August 3, 2010, 7:05 PM EDT) -- A South Dakota judge has ruled in favor of NorthWestern Energy in a dispute with certain underwriters at Lloyd's of London over coverage for environmental cleanup costs at a site in Montana, holding that a policy issued by the insurer had been triggered.

Judge Stuart L. Tiede of the Circuit Court of South Dakota, Second Judicial Circuit, issued a ruling Thursday granting NorthWestern's motion for partial summary judgment on trigger of coverage. He rejected cross-motions for partial summary judgment from the insurers on trigger of coverage...
