Total-OMV Deal Passes Antitrust Muster In Court

Law360, New York (August 5, 2010, 3:59 PM EDT) -- Contradicting a finding by Germany's antitrust watchdog, a regional court in the country has found that oil giant Total SA's proposal to buy 59 OMV AG service stations in the eastern part of the country is not an antitrust violation.

The first cartel division of the Dusseldorf Higher Regional Court said Wednesday the proposed merger would not strengthen a dominant position, rejecting the Bundeskartellamt's decision in April 2009 to block the merger.
