Dell Takes Fight Against Battery Duties To Fed. Circ.

Law360, New York (August 5, 2010, 12:31 PM EDT) -- Dell Products LP has appealed a U.S. Court of International Trade ruling that Customs and Border Protection correctly classified the technology company’s batteries for notebook computers and subjected them to a 3.4 percent duty rate.

Dell filed a notice of appeal to the U.S. Court of Appeals for the Federal Circuit in the CIT on Wednesday, following the court's June decision to grant the U.S.' motion for summary judgment and uphold Customs’ classification of Dell’s batteries as “other storage batteries” under heading 8507 of the Harmonized...
