Best Medical Sues Ex-Workers, Accuray Over Patent

Law360 (August 9, 2010, 7:44 PM EDT) -- Accuray Inc. and four employees have been hit with a consolidated lawsuit by rival medical device maker Best Medical Inc. that alleges they stole trade secrets and infringed a patent in the development of cancer treatment technology.

The defendant employees, who formerly worked for Best Medical, shared the plaintiff’s patented “intensity modulated radiation therapy” technology with their new employer, violating noncompete contracts they held with the company and its affiliates, according to a complaint filed Friday in the U.S. District Court for the Western District of Pennsylvania.
