Insurer Seeks To Put Rival On Hook For Drywall Defense

Law360, New York (August 17, 2010, 5:51 PM EDT) -- Scottsdale Insurance Co. has launched a declaratory judgment action saying American Safety Indemnity Co. has a duty to provide coverage to The Mitchell Co. Inc. in two state court suits over the construction company's installation of allegedly defective Chinese drywall.

Scottsdale, which is currently providing coverage in the underlying suits, claims that a policy that American Standard issued to Mitchell in September 2008 requires the insurer to defend and indemnify the Alabama construction company in the disputed litigation, according to a complaint filed by Scottsdale attorney...
