11th Circ. Lets Insurer Off Hook In Bad Faith Action

Law360, New York (August 18, 2010, 6:27 PM EDT) -- A federal appeals court has found that the widow of an Estes Express Lines Corp. employee cannot maintain a bad faith claim against indemnity insurer U.S. Fidelity and Guaranty Co., following a Florida high court ruling that an insured party cannot sustain recoverable damages when the insurer's actions neither caused the claimed damages nor resulted in exposure to excess liability.
