DOJ, FTC Release Horizontal Merger Guidelines

Law360, New York (August 19, 2010, 6:52 PM EDT) -- The Federal Trade Commission and the U.S. Department of Justice have finalized much-anticipated revisions to the guidelines they follow when evaluating the competitive effects of mergers.

The finalized changes released Thursday are the first major revisions to the government's horizontal merger guidelines in 18 years. They are designed to give companies a clearer view of how the antitrust agencies actually evaluate mergers by outlining the techniques and types of evidence used to determine whether a particular merger is likely to curb competition, the agencies said....
