Caviar Cos. Can't Amend FWS Permit Suit: 6th Circ.

Law360, New York (August 23, 2010, 3:26 PM EDT) -- A federal appeals court has shot down a bid from two caviar companies to revive a suit claiming the U.S. Fish and Wildlife Service failed to issue timely export permits, effectively ruining a $500,000 shipment of paddlefish roe.

The U.S. Court of Appeals for the Sixth Circuit on Thursday declined to overturn a lower court ruling denying wholesale dealer Leisure Caviar LLC and caviar buyer Bemka Corp.'s motion to alter the judgment dismissing their suit and post-dismissal motion to amend their complaint.
