Virgin Trademark Suit Lacks Jurisdiction: 11th Circ.

Law360, New York (August 23, 2010, 5:04 PM EDT) -- The U.S. Court of Appeals for the Eleventh Circuit has ruled that Florida home health care company Virgin Health lacked jurisdiction to file a declaratory judgment trademark suit against the licensing arm of British conglomerate Virgin Group Ltd.

The appeals court on Thursday affirmed a ruling by the U.S. District Court for the Southern District of Florida dismissing Virgin Health's suit, which sought a ruling that it does not infringe the Virgin trademark, for lack of personal jurisdiction under the Florida long-arm statute.
