Schering Loses Round In Sunscreen Injunction Bid

Law360, New York (August 24, 2010, 1:00 PM EDT) -- Schering-Plough Healthcare Products Inc. has lost an initial bid for a permanent injunction against Neutrogena Corp. in a false advertising suit over sunscreen advertisements, but will have a chance to pursue the request after more briefing.

In an order Friday, Judge Sue L. Robinson of the U.S. District Court for the District of Delaware said the parties could proceed with discovery on whether Schering-Plough's request meets the four factors for a permanent injunction.
