Kraft Race Bias Suit Moves Past 1st Phase

Law360, New York (August 24, 2010, 3:49 PM EDT) -- The number of plaintiffs has been reduced in a race discrimination suit alleging Kraft Foods Inc. tried to eliminate virtually all of the black managerial employees at its 450-worker Philadelphia bakery.

Judge Legrome D. Davis of the U.S. District Court for the Eastern District of Pennsylvania tossed one plaintiff, John Hunter, from the case on Monday, saying he failed to claim an adverse employment action. Nine plaintiffs still remain, including two whom Kraft tried to dispose of with motions to dismiss.
