ITC To Probe Gateway's Patent Complaint Vs. HP

Law360, New York (August 4, 2004, 12:00 AM EDT) -- The U.S. International Trade Commission will investigate a complaint by Gateway Inc. that Hewlett-Packard Co. is violating U.S. trade laws by importing computers and parts infringe its patents.

The ITC said Tuesday it would refer the case to an ITC administrative law judge, who will schedule an evidentiary hearing and make an initial decision in the case.

Gateway filed the complaint under a law known as Section 337, alleging that Hewlett-Packard imported and sold personal computers, monitors and components that violate its patents. Gateway is asking...
