Applebee's Sues Nestle Over Skillet Sensation Brand

Law360 (October 10, 2003, 12:00 AM EDT) -- Restaurant chain Applebee's has filed a lawsuit in federal court in Kansas City against Swiss food giant Nestle SA for allegedly infringing its "Skillet Sensations" trademark, the Kansas City Star reported.

Applebee's claims that Nestle, through its Stouffer Corp. subsidiary, has used the same phrase in advertising, marketing and packaging a line of its frozen food products.

The lawsuit alleges that both companies' Skillet Sensations products are aimed at similar markets and are similarly priced, causing "a likelihood of consumer confusion, deception and mistake," according to...
