Citing Errors, Fed. Circ. Remands Clearwater Patent Suit

Law360, New York (August 31, 2010, 5:24 PM EDT) -- Water treatment company Clearwater Systems Corp. has won its appeal of a ruling that commercial cooling equipment made by Evapco Inc. did not infringe a Clearwater patent and that a related patent was invalid.

The U.S. Court of Appeals for the Federal Circuit on Monday remanded the entire case to a lower court, which the three-judge appellate panel found had erred on several matters, including some claims constructions.
