$3.4M Torts Verdict Against Otis Upheld

Law360, New York (September 8, 2010, 1:02 PM EDT) -- A Massachusetts appeals court has affirmed a $3.35 million jury verdict against Otis Elevator Co. stemming from injuries caused by an escalator made by a Chinese joint venture that had licensed Otis' trademarks.

Otis must be held liable for the joint venture's negligence despite not having made or sold the escalator in question because it licensed its trademarks and production method rights to the joint venture, a three-judge panel on the Massachusetts Appeals Court ruled Friday in a question of first impression.
