Suit Challenges FDA's Authority Over Cancer Drugs

Law360 (February 26, 2007, 12:00 AM EST) -- A U.S. circuit court is set to hear arguments Thursday on whether terminally ill patients should be allowed access to drugs not approved by the U.S. Food and Drug Administration.

The hearing stems from a 2003 lawsuit the Abigail Alliance for Better Access to Developmental Drugs and the Washington Legal Foundation brought against the heads of the FDA and the U.S. Department of Health and Human Services.
